Bybit, which operates globally, including in jurisdictions like Dubai where it holds a Minimum Viable Product (MVP) License from Dubai’s Virtual Assets Regulatory Authority (VARA), has come under scrutiny from the AMF. The French regulator explicitly stated that Bybit’s operations do not comply with French regulations and may face legal repercussions. AMF might even consider potential website blocking measures.

The AMF highlighted that Bybit has been on its blacklist since May 20, 2022. It is due to its failure to adhere to current French regulatory standards. Under the French Monetary and Financial Code, platforms offering digital asset services must undergo mandatory registration as Digital Asset Service Providers (DASPs). Moreover, any platform providing such services without proper registration is deemed illegal under French law.

Given the regulatory stance and potential legal actions looming over Bybit, the AMF advised French investors to brace themselves for the possibility of the platform abruptly halting its services to French residents.

The AMF’s vigilance underscores the regulatory challenges surrounding cryptocurrency exchanges operating in jurisdictions with varying degrees of oversight. With the crypto landscape constantly evolving, regulatory bodies worldwide continue to tighten their grip on digital asset platforms.
