Denmark’s financial watchdogs are taking a strict stance in the form of a crackdown on crypto exchanges and payment processors. It is happening because of a ban on local banks holding cryptocurrencies. The move aims to safeguard the banks from trading risks. The Danish Financial Supervisory Authority (DFSA) has now ordered Saxo Bank, a Danish financial firm, to sell its cryptocurrency assets.
Danish Financial Watchdog Cites Regulatory Breach in Saxo Bank’s Crypto Operations
According to the DFSA, Saxo Bank’s involvement with cryptocurrencies exceeds the permissible scope of banking activities. It is outlined in Denmark’s Financial Business Act, as stated under section 24. The bank allows its clients to trade various cryptocurrencies on its platform. It also offers crypto-linked exchange-traded notes (ETNs) and exchange-traded funds (ETFs) for speculative purposes.
The DFSA’s notice also mentioned the European Markets in Digital Currencies legislation (MiCA). It emphasizes that its full implementation is expected by December 2024. Until then, the region remains unregulated in crypto-related trades.
Despite the DFSA’s directive, Lasse Lilholt is head of Saxo Bank’s global communication. He assured the media that the bank will continue offering digital currency services. The bank intends to carefully examine the judgment and formulate an appropriate response. It is also worth noting that Saxo Bank’s customers do not directly purchase cryptocurrencies. However, invest in financial instruments tied to their value fluctuations.
Danish Crypto Startup Receives DFSA Approval for Expanded Operations in Europe
Lilholt highlighted that Saxo Bank holds only a small portfolio of cryptocurrencies. It is mainly a verge against market risks associated with crypto asset trading. The bank primarily relies on exchange-traded and approved products. It reduces significantly the potential risks which are involved. Consequently, the DFSA’s decision is not expected to have a significant impact on the bank’s operations.

It seems that Danish financial authorities have been dealing with how to regulate cryptocurrencies. Some legal experts in Denmark argue that digital currencies do not fall under the purview of the DFSA. It also includes Bitcoin (BTC). According to expert opinion, they do not meet the definition of financial service.
However, despite the uncertainty, in April 2023, the DFSA granted Danish crypto startups permission to operate in 30 countries. However, it will be within the European Economic Area. Moreover, in March, the Supreme Court of Denmark issued two rulings regarding the taxation of Bitcoin sales. Furthermore, it highlighted the ongoing discussions surrounding cryptocurrencies in the country.
