NAB Fined $41.87 Million By Australian Court Over Fees For No Service

The Australian Federal Court has ordered MLC Nominees Pty Ltd and NULIS Nominees Limited to pay a fine of 57.5 million AUD, which is about $41.87 million. Both of these companies stand as entities of the National Australia Bank (NAB), particularly its wealth management division.

Both of these entities have been found to be involved in making misleading and false regarding various charges and associated service fees to their various superannuation members.

The Acts In Question

An announcement was made on Monday detailing the crimes in question. MLC Nominees had managed to mislead members of two MasterKey Product divisions: MasterKey Personal Super (MKPS) and MasterKey Business Super (MKBS). In total, they misled 220,000 members during the time frame of September 2012 and June 2016, and had deducted around 33.6 million AUD, or about $24.47 million, in various fees.

Alongside this, NULIS, as well as MLC Nominees, had deducted an approximate of 71.9 AUD, or about $52.36, from 457,000 members. This was for Plan Service fees, and was done between September of 2012 and September of 2018. All of these members were subsequently charged for services of Plan Advisors; however, none of these members had ever received such a service.

Crime And Punishment

As a result, the Australian Federal Court had found these two entities guilty of breaching the Corporations Act, as well as the ASIC Act. Alongside this, the Court highlighted other non-compliance regarding other financial services.

The total fine has been divided between the two entities.NULIS has been imposed with a fine of 8 million AUD ($5.83 million), while MLC Nominees was hit with a fine of 49.5 million AUD ($36.05 million). The civil penalty’s proceeds will be given the Australian Securities Investments Commission (ASIC).

The Mandatory Public Statement

Daniel Crennan QC stands as the Deputy Chair of ASIC, and gave a statement about the matter. He explained that the Court penalty stands as a reflection of the serious contraventions by both NULIS and MLC Nominees. He highlighted that this is the largest civil penalty in total that has ever been imposed by a civil action imposed by ASIC.

Crennan highlighted that it is especially egregious to mandate fees without conducting any services, and has resulted in the financial loss of an array of consumers that had not expected it. Crennan further promised that ASIC would continue its mandate of enforcing actions against various financial misconduct, as well as other case studies from the Financial Services Royal Commission.
