Senate Leader Thune Files Cloture Motion on Crypto Clarity Act

US Senate Majority Leader John Thune (R-S.D.) has filed a cloture motion on the Digital Asset Market Clarity Act. This move will bring the cryptocurrency market structure bill closer to a Senate floor vote. The procedural vote is now scheduled for September 15, following lawmakers’ return from the August recess. Earlier, voting on CLARITY Act was expected on Friday, 7th August.

The Clarity Act seeks to establish a clearer regulatory framework for digital assets by defining the respective oversight roles of the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC). The legislation aims to reduce regulatory uncertainty by providing clearer classifications for digital assets and determining which federal agency should oversee them.

Clarity Act Must Secure 60 Votes to End Senate Debate

The filing marks a significant step toward advancing the legislation, although it does not represent final approval. A cloture motion requires 60 votes to end debate and proceed with consideration of the bill. With Republicans holding a Senate majority, the legislation would require support from at least seven Democrats or independents if all Republicans vote in favor.

The legislation previously secured bipartisan support in the House, passing in July 2025. It later advanced through the Senate Banking Committee with a 15-9 vote in May 2026.

However, lawmakers still need to resolve several disagreements before the bill can advance further. The outstanding issues reportedly include ethics provisions concerning government officials’ relationships with digital assets, measures targeting illicit finance, stablecoin yields and rewards, and provisions originating from the Senate Agriculture Committee.

Senate Faces Limited Window to Advance Crypto Legislation

Thune’s move comes after the Senate postponed consideration of the legislation before lawmakers left Washington for the month-long August recess. The September 15 procedural vote could therefore provide an important opportunity for lawmakers to advance the bill before congressional attention increasingly shifts toward the November midterm elections.

If the Clarity Act successfully passes the Senate, it would still need to return to the House for further consideration before potentially reaching the president for approval. With the procedural vote approaching, lawmakers have several weeks to address the remaining disagreements.

The cryptocurrency industry has long called for greater regulatory clarity, particularly regarding the distinction between digital commodities and securities. Crypto fraternity on the other hand is now of the view that the industry has survived 17 years without this act very well and will survive in future as well.
