Recently, a court in South Korea rejected the 2nd application filed for the arrest warrant targeting Daniel Shin (the co-founder of Terraform Labs). The court repeated that it does not have any concerns regarding him either dealing with fleeing or tampering with the evidence related to the Terra crash investigation. On the other hand, the prosecutors think that Shin had been a collaborator in the fraud led by Do Kwon (the founder of Terraform Labs).
Court Disproves the 2nd Request to Arrest Daniel Shin Saying There Are No Concerns Regarding Him
Formerly, in 2022’s December, the court denied granting the initial arrest-warrant application for Shin. Terraform Labs was established by Kwon and Shin back in 2018. Currently, Do Kwon is under the custody of the authorities in Montenegro. The charges being faced by Kwon take into account the utilization of bogus travel documents. The co-founders are both natives of South Korea.
The South Korean prosecutors have accused them of breaching trust as well as the infringement of the law covering the capital markets after the crash of Terra-Luna. The project once had a valuation of up to $40B. As a result of the Terra collapse, several investors incurred great losses. On the other hand, Shin has straightly denied the accusations raised by the prosecutors.
South Korean Prosecutors Do Not Intend to File a 3rd Request
He claimed that he does not have any connections with Kwon since the year 2020, meaning well before the implosion of the platform. Seoul Southern District Court’s Judge Yoo Hwan-Woo is of the view that a few of the allegations against Shin have some space for argument. The prosecutors pointed out that they do not intend to file 3rd request for the arrest warrant.

In addition to this, the prosecutors are making efforts for Kwon’s extradition from Montenegro. At the end of the previous year, Kwon fled his home based in Singapore. This was witnessed following the issuance of a “red notice” by Interpol at the request of South Korea. Kwon also rejected the entirety of the charges leveled against him.
The respective allegations were based on an investigation that was initiated by the prosecutors into the Terra-Luna collapse. Terraform labs claimed that the accusations mentioned in the investigation were not valid at all. It also asserted that the inquiry has turned into a political one.
