In a crucial enforcement move, the United States Securities and Exchange Commission has submitted settled charges confronting Mango DAO as well as Blockworks Foundation. As per the SEC, the charges against these entities take into account the “$MNGO” governance coins’ sale and the unlicensed broker activities dealing with the crypto trading platform of Mango Markets.

SEC Alleges Mango Markets of Unregistered Sales of $MNGO
In its exclusive press release, the securities regulatory agency provided the details of the allegations. The SEC reportedly registered a complaint with the U.S. District Court for the Southern District of New York. In its complaint, the securities regulator has accused the platforms of collectively raising more than $70M from investors worldwide. The entities allegedly amassed this huge figure via “MNGO” tokens’ unregistered sales.
These coins were promoted as governance tokens without any required regulatory approvals. This deprived the investors of crucial protections that the federal securities regulations established. Additionally, the regulator accuses Mango Labs LLC and Blockworks Foundation of operating as unlicensed brokerage entities. The platforms reportedly conducted several activities like recruiting and soliciting consumers for trading securities on the platform of Mango Markets.
In this respect, they offered allegedly investment advice apart from facilitating transfers, all without adequate registration. The SEC stresses that working within a decentralized agenda does not free an entity from complying with implemented securities regulations. Acting Chief of the Crypto Assets and Cyber Unit of the SEC, Jorge G. Tenreiro, also commented on this move.

As per the official, the ‘DAO’ status does not alter the reality of the party at the back of a project. Thus, they need to get registered just like the other entities. Carrying out securities intermediation needs registration, irrespective of the legal structure or technology. The respective statement signifies the determination of the securities regulator to hold cryptocurrency platforms accountable for the activities they perform.
The Accused Entities Agree to Recompense $700K in Civil Penalties
As included in the settlement, Mango Labs, Mango DAO, and Blockworks Foundation will pay a total amount of almost $700K in civil penalties. Moreover, these entities have also agreed to move toward substantial remedial actions like the “MNGO” coins’ destruction, removal, and solicitation for trading platforms.
