Gemini has taken legal action against DCG and its founder, Barry Silbert, filing a lawsuit on Friday. In response, DCG claims that this is just another attempt by Winklevoss to escape responsibility for leading the Gemini Earn initiative. The mediation process is likely to be concluded using Chapter 11 bankruptcy legislation.
Gemini Claims Barry Silbert Planned Fraud with DCG and Genesis
Today, the Gemini has filed a lawsuit against DCGco and Barry Silbert individually in a New York court. It is alleged that Barry intended and composed the DCG and Genesis scam against creditors. Furthermore, it also actively participated in the scheme.
The complaint provides a detailed record of events. In short, Gemini informed Genesis about ending the Earn program in October 2022. Barry reached out to Gemini to schedule a meeting. He attempted to persuade them to continue with Earn. Despite being well aware of Genesis’s terrible financial situation, he persisted.
Barry claimed that Genesis only faced a timing issue. However, in reality, the company had significant financial problems that he was trying to hide. When Three Arrows Capital (3AC) went bankrupt in June 2022, it created a 1.2 billion USD hole in Genesis’s financials. To cover up the truth, Genesis insisted that operations were continuing normally after DCG agreed to bear the losses.
Gemini Lawsuit Exposes DCG’s Financial Deceit
This elaborate deception has now been exposed. DCG did not suffer any major losses. Instead, DCG secretly issued a 10-year, 1% interest promissory note to Genesis. It is actually worth only a small fraction of the purported $1.1 billion.
In an attempt to deceive Gemini and its creditors, Barry, DCG, and Genesis fabricated financial reports. The fake promissory note somehow made its way into the report as a Current Asset. This was a complete fabrication and a false statement.
On the fake income statement, the promissory note was listed as a 1.1 billion USD receivable. This was yet another act of deceit. To hide the promissory note in their loan calculations, Genesis simply pretended it didn’t exist. It was intentionally left out of the equations, another fabrication.

In addition, the top-level executives are involved in this scam. DCG officials, including Barry Silbert, repeatedly lied to keep the truth hidden from Gemini and other creditors.
Genesis shared its falsified financial records with Mark Murphy, DCG’s current President and COO. Murphy was well aware that news accounts exaggerated DCG’s financial support for Genesis. Though, it remains unclear if he made any effort to correct those accounts.
