The Hong Kong government is reaching out to the public for their opinions on a set of legislative proposals aimed at overseeing stablecoin issuers. The proposed Hong Kong stablecoin regulations would mandate that only stablecoins issued by licensed entities can be sold to retail investors. Additionally, a sandbox arrangement is set to be launched to allow for the testing of these new rules. The consultation period for gathering public input on these proposals will run from December 27, 2023, to February 29, 2024.

Proposed Regulatory Framework for Stablecoin Issuers in Response to Growing Significance
The proposed legislation, jointly issued by the Financial Services and the Treasury Bureau (FSTB) and the Hong Kong Monetary Authority (HKMA), is a response to the increasing significance of stablecoins in the Web3 and virtual asset ecosystem. With the growing connection between traditional financial systems and virtual asset markets, the government sees the need for a regulatory framework for fiat-referenced stablecoin (FRS) issuers. This approach aims to effectively manage potential monetary and financial stability risks while providing transparent guidelines in the expanding virtual asset landscape.
The key features of the legislative proposal include the introduction of a licensing regime requiring FRS issuers to be licensed by the Monetary Authority (MA) under specific conditions. It mandates that FRS can only be offered by specified licensed entities, and only those licensed by the MA can offer FRS to retail investors. The proposal also prohibits advertising FRS issuance by unlicensed entities and non-specified licensed entities’ offering of FRS. The authorities will be given the necessary powers to adjust stablecoin parameters, and a transitional arrangement will facilitate the implementation of the regulatory regime.
In addition to the regulatory measures, the HKMA will introduce a sandbox arrangement to communicate supervisory expectations and provide guidance on compliance to entities interested in issuing stablecoins in Hong Kong. This arrangement will allow for feedback from these entities on the proposed regulatory requirements.
Leadership Perspectives on Regulatory Measures for Web3 Ecosystem Development
Secretary for Financial Services and the Treasury, Mr. Christopher Hui, highlighted the significance of these measures in developing Hong Kong’s Web3 ecosystem. The introduction of a licensing regime, combined with appropriate supervision and enforcement, is seen as a crucial step in managing risks associated with stablecoin development.
Chief Executive of the HKMA, Mr. Eddie Yue, emphasized the importance of regulatory guardrails and standards to ensure the responsible development of the virtual asset ecosystem. The sandbox arrangement, along with the public consultation, aims to create channels for exchange of views between the HKMA and entities planning to issue stablecoins in Hong Kong.
The consultation period is now open, concluding on February 29, 2024. The consultation paper containing detailed information is available on the FSTB and HKMA websites, inviting industry and public comments through email or post.
