The financial authorities in Korea have reportedly presented guidelines regarding non-fungible tokens. The guidelines reportedly take into account the categorization of the NFTs that are included among the virtual assets in line with the upcoming ‘Virtual Asset User Protection Act.’ The respective Act will reportedly witness its implementation starting from the 19th of July.

Hence, the authorities have issued guidelines on the classification of certain non-fungible tokens among virtual assets. Formerly, the authorities had stated that these tokens lie outside the virtual assets. In line with the latest Act, the business operators issuing the non-fungible tokens must report their operations. Neglecting the guidelines would result in penalties for the non-complying companies.
After the Act’s implementation, the class of non-fungible tokens will see a significant change. According to the reports, the normal NFTs that people trade to collect content will go outside the virtual asset sector. Additionally, the authorities will judge the non-fungible tokens with blurry boundaries in line with their substance. Based on this examination, they will classify them as securities or virtual assets.
Moreover, the authorities focus on the ‘Token Securities Guidelines’ of the Financial Services Authority to determine the assets’ category. If the licensed content of the investors comprises securities, the securities regulations will apply irrespective of the technology or form. Nonetheless, the agency has not offered a precise number of particular criteria dealing with the risk of regulatory exploitation.
The FCA Will Reportedly Follow No Absolute Standard for Non-Fungible Tokens’ Classification
The agency added that it may categorize a non-fungible token among the crypto assets if it has certain qualities. These take into account the fair exchange, mass production, and the capability of fractionalization. Additionally, if the consumers can use them for making payments, they can come under the category of crypto assets.
Contrarily, virtual assets having little economic value along with no transferability would stand among the normal non-fungible tokens. However, the agency would reportedly conduct a case-by-case review of the NFTs to make a distinction among these categories. Furthermore, it will not use any absolute standard for the interpretation of the non-fungible tokens as crypto assets.
