Portland Sent a Subpoena on Uber’s Greyball Software

Portland authority will issue a legislative subpoena directed to Uber Technologies Inc. Uber admitted that it used Greyball software to evade local transportation authorities that tried to clamp down its services. This particularly happened it areas, where the online transportation service had not been approved. They include Portland, Oregon. The company said that the software aimed at checking the ride requests and protecting the drivers.

However, Portland authorities had suspected something wrong since the New York Times leaked its existence in March 2017. Since then, the government had tried to investigate the software. In response, Portland authorities wanted to force the Uber Technologies Inc to disclose the software.  Uber Technologies Inc had not turned over the software.

In response to what Uber had done Portland city council agreed to to direct the attorney’s office to ask legislative questions to Uber about the software. The commissioner Chloe Eudaly noted that she had suspected that the online transportation company had attempted to flout the laws. However, no comment had been obtained from Uber company. The spokesman could not be contacted. Previously, the company representative noted that they had provided the city council with relevant information for its investigation.

Last week, Reuter reported that the US Department of Justice had conducted a criminal investigation related to Greyball software. Northern California had also sent legislative subpoena related to Uber’s Greyball program. Portland authorities collected information on the subpoena from the Northern California grand jury. The information included emails between Uber and the city authorities.

A subpoena does not always indicate a criminal case or charges. Instead, it is a legislative request for information or testimony related to a suspected crime or potential crime. In the case of Greyball software, Portland city council issued a legislative request for documents related to the company’s activity in the area, particularly related to the software.

Reasons behind Subpoena for Uber’s Greyball Software

Uber Technologies Inc was suspected to use a software app to evade transportation regulations in Portland, Oregon, in 2014. The company operated illegally in the area. Before, the company did not respond to the city’s request for the company to submit documents related to Greyball. Since then, Portland began investigations even though the company representative said that the software had been stopped.

Of course, the city council might agree that the online transportation service benefited the community. However, they have to make sure that everybody or every company complies with the local regulation. Therefore, the city officials are now looking for playbook of the company’s activity and the actual software. After accepting the subpoena, the company will have 3 days to respond. No one knows how Uber Technologies Inc will respond. However, if it refuses to comply, the city council can force the company to comply by appealing to a court.

The subpoena is a legislative move taken by city council to protect the local transportation laws. This expected to avoid the similar case from happening in the future. Every transportation company – both land-based and online – has a duty to comply with the local regulations.
