New Rules for Digital Wallet and Key Management Come into Effect by Thai SEC
On January 16, 2023, a new set of regulations regarding digital wallets and the management of keys took effect. These regulations outline the strategy and methods for designing, producing, and administering digital wallets, and for correctly and efficiently establishing, preserving, and obtaining keys and other relevant information.
In addition to these guidelines, the regulations also require digital asset companies to have a backup plan in place if the management system for keys and digital wallets is disrupted by an unforeseen circumstance. This includes naming the people who are responsible, outlining and testing the steps for taking action, and reporting the incident.
Furthermore, if there is any occurrence that compromises the security of systems associated to digital asset custody and has the potential to have substantial repercussions for clients’ assets, both an audit of the system’s security and a digital forensic investigation are obligatory requirements.
Digital asset company operators who already had offered custodial rights of clients’ assets immediately preceding the date of the regulatory frameworks are obligated to fully adhere to these regulations within 6 months of the date of issuance of the regulatory requirements. This requirement goes into effect as soon as the regulations take effect, meaning that companies must comply with these new regulations immediately.
